When your application form is in pending and your trademark is not yet registered, the ‘TM’ symbol can be used along with your brand.

‘SM’ Symbol

The ‘SM’ symbol is also used when your trademark is not net registered but, this symbol is used for a source of service, when ‘TM’ symbol is used for products.

Trademark Rectification

If the Trademark registrar marks any omission or error in your trademark after the trademark registration, you can rectify and resubmit the trademark application. This process is known as the Trademark Rectification and it is a legal process made by an applicant.

Trademark Objection

If the trademark registrar marks any objection for your trademark registration, then you can provide a written reply for that. You should clearly provide the reasons and evidences for your trademark registration in your written reply. If your reply satisfies the trademark examiner then your application will be published in the trademark journal, before the registration.

Trademark Opposition

If the trademark registrar approves your application in trademark journal for advertisement before the registration, any business entity or even a person from the public can oppose your registration mark. In such cases, the applicant should file a counter along with the trademark registrar within two months.

Trademark Renewal

The trademark renewal application must be prepared and filed before the expiry date in order to avoid the unwanted disputes.
